Disclaimer & Assumption of Risk

Last updated

DARCE is operated by Kellert Labs (Australia).

DARCE helps you analyse combat-sports footage. It is a training aid only. It is not a coach, an instructor, a referee, a medical professional, or a substitute for qualified, in-person supervision.

This Disclaimer forms part of our Terms of Service. Please read it before you rely on the Service or train.

In plain English

  • Combat sports are dangerous and can cause serious injury or death. You take on that risk.
  • DARCE’s analysis is general information generated by AI — it can be wrong, and it isn’t medical or coaching advice.
  • Always train under a qualified instructor, in a safe environment, within your limits.
  • See a doctor before you start or continue training, and stop if something feels wrong.
  • Nothing here removes rights you can’t legally waive, including under the Australian Consumer Law.

This summary is for convenience only and is not part of the agreement. The full text below governs.

Warning

Grappling, striking, wrestling and mixed martial arts are physically demanding contact activities that carry an inherent and significant risk of serious injury, permanent disability and death. By using DARCE and by training, you accept those risks. If you are not willing to accept them, do not train.

02Not medical or health advice

DARCE does not provide medical, health, nutritional or psychological advice, and nothing in the Service is intended to diagnose, treat, cure or prevent any condition. Before you begin or continue any training programme, you should consult a qualified medical professional, particularly if you have or may have an injury, illness, or any heart, respiratory or other condition, or if you are pregnant.

If you feel unwell, dizzy, faint or in pain while training, stop immediately and seek medical help. Do not use the Service as a reason to delay seeking professional advice.

In an emergency

DARCE is not a monitoring, safety or emergency service. In an emergency, call 000 (in Australia) or your local emergency number immediately.

03Not coaching or professional advice

The breakdowns, scores, drills and recommendations the Service produces are general information, not professional coaching, instruction or advice tailored to you. They are no substitute for a qualified coach or instructor who can see you in person, assess your level and supervise your training safely.

Always train under proper supervision. You should only practise techniques in a safe, supervised environment with a qualified instructor, appropriate equipment and a willing, consenting training partner. Some techniques shown or suggested can cause serious harm if performed incorrectly or without proper instruction.

04The AI has limits — do not rely on it for safety

The Service uses automated and machine-learning systems. These can make mistakes. Analysis may be inaccurate, incomplete, out of context, or simply wrong, and a recommendation that suits one person may be unsafe or unsuitable for you, your body, your level or your situation.

You are responsible for judging whether anything the Service suggests is safe and appropriate, and for checking it with a qualified instructor. Do not rely on the Service to make decisions about your health, safety or wellbeing.

05No guarantee of results

We do not promise any particular outcome from using the Service. Improvement in skill, fitness, performance or competition results depends on many factors outside our control, including your effort, coaching, genetics, recovery and consistency. Any examples or testimonials are not a guarantee that you will achieve similar results.

06Assumption of risk

You understand and voluntarily accept that combat sports and the training, drilling and sparring associated with them involve inherent risks that cannot be eliminated, including (without limitation):

  • strikes, throws, takedowns, joint locks, chokes and impacts;
  • concussion and other head, brain, neck and spinal injuries;
  • broken bones, dislocations, sprains, strains, cuts and bruising;
  • cardiac, respiratory or heat-related events;
  • aggravation of existing conditions; and
  • serious injury, permanent disability or death.

These risks can arise from your own actions, the actions of training partners or others, equipment, playing surfaces, or conditions. Knowing this, you choose to use the Service and to train, and you assume full responsibility for those risks.

07Your responsibilities

  • Train only within your physical limits and current skill level.
  • Warm up properly and use appropriate protective equipment.
  • Follow the rules, instructions and supervision of your gym, academy and coach.
  • Make sure everyone you film and train with consents, as required by our Terms of Service and Acceptable Use Policy.
  • Stop immediately if you are injured, in pain or unwell, and seek medical help.

08Release and waiver

To the maximum extent permitted by law (including, where applicable, provisions relating to the supply of recreational services), you agree that you use the Service and train at your own risk, and you release Kellert Labs and its personnel from liability for any loss, injury, damage or claim arising out of or in connection with your use of the Service, your reliance on its outputs, or your participation in training or other physical activity, including where caused by ordinary negligence.

What this does not affect. Nothing in this Disclaimer excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that the law says cannot be excluded, restricted or modified — including the consumer guarantees under the Australian Consumer Law, and any liability for death or personal injury to the extent the law does not allow it to be excluded. To the extent the law permits us to limit our liability, our liability is limited as set out in our Terms of Service.

09We are not your coach, gym or partner

We do not operate any gym or academy, employ any coach, or take part in your training. We are not responsible for the acts or omissions of your coaches, instructors, training partners, gyms, venues or events, all of whom set and enforce their own rules and safety standards.
