# Privacy Policy

Last updated 24 October 2026

DARCE is operated by Kellert Labs Pty Ltd (Australia).

This Privacy Policy explains how Kellert Labs Pty Ltd collects, uses, discloses and protects your personal information when you use the DARCE app, our website at darce.app, and related services (the "Service").

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). "Personal information" means information or an opinion about an identified individual, or one who is reasonably identifiable. By using the Service you agree to this policy and to our [Terms of Service](https://darce.app/legal/terms).

In plain English

- We collect your contact details, your account and usage data, and the training footage you upload.
- Footage can show you and other people, so treat it as sensitive. We only use it to give you your breakdown.
- Footage starts uploading securely when you select it in the app. If you don't go ahead with the analysis, we delete it automatically.
- We delete uploaded footage within 30 days of analysis unless you choose to save it, or you have opted in to model training and we have labelled it.
- We never use your footage to train our AI for others unless you switch that on. It’s off by default.
- Other athletes can see your profile card, and in your groups and on the Near you board some of your training activity. Training partners you both agree to can also see your Fighter IQ unless you turn that off, and keep any session or clip you tag them in once they confirm it. Pausing your account hides you, apart from what a partner has already kept.
- You can ask to access, correct or delete your information, or complain, at any time.

This summary is for convenience only and is not part of the agreement. The full text below governs.

## 1. About this policy and who we are

DARCE ("DARCE", "we", "us" or "our") is operated by Kellert Labs Pty Ltd, a proprietary limited company based on the Sunshine Coast, Queensland, Australia (ABN 90 701 212 213).

We are responsible for the personal information we hold about you. This policy applies to all of the Service. If you have any questions, contact our Privacy Officer using the details at the end of this policy.

## 2. The information we collect

### Information you give us

- Waitlist sign-ups: your name, email address, country and age, your phone number if you add it, your answers about the features you would use and what you train (including any words you type in), whether you agree to receive marketing emails, and where the sign-up came from (the first page you visited, the referring site, any campaign tag on the link you followed, and, if you choose to tell us, how you heard about DARCE). Once you have entered your email address, we save what you have filled in so far, even if you don't finish.
- Create & Earn applications: your name, email address, the social media accounts you list (Instagram, TikTok, YouTube or X) and any note you add. Your application is emailed to our own inbox and kept there; it is not added to our app or waitlist records. To consider it, we may look at the public posts and audience of the accounts you list.
- Account and profile: your name, email address, password, and details you choose to add such as your sport, experience level, gym or goals.
- Payments (if and when paid plans launch): you pay through the Apple App Store or Google Play, which take your payment and keep your billing details under their own privacy policies (the [Apple Privacy Policy](https://www.apple.com/legal/privacy/) and the [Google Privacy Policy](https://policies.google.com/privacy)). We never see your card details. We receive a record of your purchase, such as the plan and your subscription status, through RevenueCat, the subscription service our app uses, linked to your DARCE account.
- Support and communications: the content of messages you send us and our correspondence with you.

**Questions you ask on our website.** If you type a question into the Ask anything else box on darce.app and we have no saved answer for it, we keep the question's words (up to 200 characters, with any email address or phone number we spot removed), how many times it has been asked and when, so we can add an answer. We don't link it to your name, email address or device. Please don't include personal details.

### Footage and content you upload

**This is the most sensitive information we handle.** When you record or upload training footage, we collect that video and audio, which may show the faces, bodies, voices and movements of you and other identifiable people. We also generate derived information from it (for example detected positions, transitions, scores, weaknesses and recommended drills) and link it to your account.

To make your analysis ready sooner, footage you select in the app is compressed on your device and begins uploading securely to your private storage area as soon as you pick it, before you submit it for analysis. We only analyse it after you confirm on the upload screen. If you do not go ahead (for example you pick a different video or leave the upload screen without submitting), the uploaded file is deleted from our servers automatically.

### Information we collect automatically

- Device and app data: device type, operating system, app version, identifiers and settings.
- Usage data: features you use, actions you take, and how you interact with the Service.
- Product-analytics and session-replay data: through our analytics provider (PostHog) we collect in-app events (the features and actions you use) and, where session replay is enabled, recordings of how you interact with app screens. Replays are designed to mask the text you enter, and are used only to diagnose problems and improve the Service.
- Log and technical data: IP address, approximate location derived from it, browser type and user-agent, and timestamps.
- Emails we send you: whether an email from us was delivered, opened or bounced, which of its links you clicked, and whether you replied, recorded through a small image and tracked links in the email. You can stop the open tracking by not loading images in your email app.
- Waitlist sign-up checks: when you join the waitlist we check the sign-up for automated abuse, using our hosting provider's bot protection and a count of recent sign-ups from your internet connection, kept for two days as a scrambled value rather than your IP address.
- Cookies and similar technologies on our website: see our [Cookie Policy](https://darce.app/legal/cookies).

### Information from third parties

We may receive limited information from app stores, analytics or infrastructure providers, and from anyone who refers you, in each case to operate and improve the Service.

## 3. Sensitive information and consent

Training footage can include "sensitive information" under the Privacy Act, such as images and other information about identifiable individuals and their physical activity or health. We collect and use this information only where it is reasonably necessary to provide the Service and you have consented. You consent to us receiving and storing footage by selecting it for upload in the app, and to us analysing it by confirming on the upload screen. If you do not confirm, the footage is deleted automatically as described above.

Your responsibility

Because footage can show other people, you must have the consent of everyone who appears in it before you upload it. You are responsible for obtaining that consent, as set out in our Terms of Service and Acceptable Use Policy.

**Using footage to improve our AI is opt-in.** By default we do not use your footage to train our models for the benefit of other users. We only do so if you turn on the optional training-data setting, and you can turn it off again at any time.

## 4. How we use your information

We use personal information to:

- provide, maintain and personalise the Service, including generating your breakdowns, drills and progress;
- run the AI analysis that powers the Service;
- create and manage your account and respond to your requests and support enquiries;
- consider Create & Earn applications and contact you about the program;
- keep the Service safe and secure, prevent and investigate misuse, and enforce our terms;
- understand and improve the Service, including through aggregated or de-identified analytics, and (only if you opt in) by improving our models;
- if you have opted in to improving our models, let a member of our team watch your footage to label positions and techniques for training, and keep the footage we have labelled for as long as you stay opted in, under the protections described below;
- measure and improve our advertising, only with your consent to advertising cookies;
- send you service messages and, where you have not opted out, occasional product updates; and
- comply with our legal obligations and exercise or defend legal rights.

We show anonymous totals in the app, such as how often a move works across all athletes. They never name or identify you.

We collect personal information only by lawful and fair means, and generally directly from you. Where we collect information for a particular purpose, we will not use it for an unrelated purpose without your consent unless an exception under the APPs applies.

## 5. Who we share your information with

**We do not sell your personal information.** We share it only as needed to run the Service or as required by law, including with:

- service providers who host and operate the Service (for example cloud hosting, database and storage providers such as our hosting and Supabase infrastructure);
- AI and machine-learning providers that process footage to generate your breakdown;
- communications and customer-relationship tools we use to email you and manage enquiries (for example Resend, which sends our emails, tells us whether they were delivered, opened or clicked, and receives a copy of any reply you send to them);
- the Apple App Store and Google Play, and RevenueCat, the service that manages subscriptions in our app, if and when paid plans launch;
- analytics and security providers that help us run, understand and protect the Service (for example PostHog, for product analytics and, where enabled, session replay);
- advertising partners such as Meta, only if you accept advertising cookies;
- our professional advisers (such as lawyers and accountants) where reasonably necessary;
- government bodies, courts or law-enforcement where we are required or authorised by law, or to protect safety or our rights; and
- a buyer or successor if we sell or reorganise our business, subject to this policy.

We require our service providers to protect your information and to use it only for the purposes we engage them for.

**Other athletes on DARCE.** Some features show your information to other signed-in athletes. Your public profile card shows your display name, photo, belt, a general location such as your city and region, your bio and any social handles you add. Members of the groups you join can see your name, photo and role in that group, and your training activity there, such as your mat time and sessions on the group board, the classes you say you are in for, your milestones and any rounds you share there. Videos you share into a group can be watched by its members until they're deleted, within 30 days after the round was analysed, and may show the people you trained with. If you add a location, athletes in your area can see your name, photo and mat time for the current week or month on the Near you board. If you and a member of one of your groups both switch on comparisons, each of you can see a head-to-head matchup built from rounded figures of your training and body stats. Training partners are athletes you have both agreed to add. Your training partners can see your Fighter IQ, with its numbers rounded, unless you switch that off in the app. When you tag a training partner in a session or a sparring clip and they confirm it, it is added to their own training record. For a session, that is its date and times, martial art, type, length and rounds, with your name as the person they trained with. For a clip, it is the analysis seen from their side, including the movement data of you both. Tagging never gives them your video, your notes, or the summary and fixes written for you, though they do see the round's key moments from their side. A session or clip a partner has confirmed stays in their record even if you later delete the session or the clip's video on your side, remove them, block them or close your account. A session keeps your name as they saw it, while a clip stops showing your name once you block them or close your account. When a training partner tags you as they log their own session, your name goes into their record of it as they save it, whether or not you confirm, and it stays there even if you decline, remove or block them, or later close your account. When you close your account we delete the movement data from your video from our servers, but a copy already saved on their phone can stay there, and keep playing, until they sign out or newer rounds push it out. You can block another athlete at any time, which ends your partnership and stops them requesting you, tagging you or seeing your profile card and Fighter IQ, though it does not hide you in a group you both belong to or on the Near you board. You can pause your account in the app at any time, which hides you from all of these, apart from what a training partner already keeps in their own record.

## 6. Overseas disclosure

Our primary database and the footage you upload are hosted by our infrastructure provider, Supabase, on servers in Tokyo, Japan. Other service providers (for example our AI processing, analytics or communications providers) may store or process information in the United States or other countries where they operate. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the APPs.

By using the Service and uploading content, you acknowledge that your information may be stored and processed overseas, and that overseas recipients may be subject to different privacy laws than those in Australia.

## 7. How long we keep your information

**Footage is short-lived by design.** Unless you choose to save a video in your account, we delete uploaded footage within 30 days after it has been analysed. Where you save a video, we keep it until you delete it or close your account. Where you have opted in to improving our models and a member of our team has labelled a video for training, we keep that video for as long as you stay opted in; switch the setting off and it is deleted on the normal schedule. Footage that uploads but is never submitted for analysis is deleted automatically when you leave the upload flow. Sharing a video into a group does not save it: it is deleted on the same schedule, along with the still image the group sees on it.

We keep other personal information only for as long as we need it for the purposes in this policy: for example, account information while your account is open, waitlist sign-ups until launch or until you ask us to remove them, Create & Earn applications while we consider them, and for as long as you take part if you join the program, or until you ask us to remove them, unanswered website questions until we have added an answer or no longer need them, and records we are required to keep by law. What a training partner keeps in their own record, such as a session or clip they confirmed, stays there after you close your account, as described under Other athletes on DARCE above. We may keep de-identified or aggregated data, which can no longer identify you, indefinitely. Information may persist for a short time in secure backups before being overwritten.

## 8. How we protect your information

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, encryption in transit, and restricting access to those who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please help protect your account by keeping your login details confidential.

If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme, including notifying affected individuals and the Information Commissioner where required.

## 9. Your rights and choices

**Access and correction.** You can ask for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Much of it is available directly in your account. To make a request, contact us using the details below; we may need to verify your identity, and we will respond within a reasonable time (usually within 30 days).

**Deletion and export.** You can delete your account at any time in the Service, which removes your content in line with the retention section above, and you can export your data where that feature is available. Some information may be retained where the law requires.

**Consent and marketing.** Where we rely on your consent, you can withdraw it at any time (for example by turning off the training-data setting). You can opt out of product emails using the unsubscribe link or by contacting us; we will still send essential service messages.

## 10. Cookies and similar technologies

Our website uses a small number of cookies and similar technologies. How they work and how to control them is explained in our [Cookie Policy](https://darce.app/legal/cookies).

## 11. Children's privacy

The Service is not intended for children under 16, and we do not knowingly collect their personal information. If you believe a child has provided us with personal information, please contact us and we will take reasonable steps to delete it.

## 12. Third-party links and services

The Service may link to or rely on third-party sites and services that we do not control. This policy does not cover their practices, and we encourage you to read their privacy policies.

## 13. Changes to this policy

We may update this policy from time to time. If we make a material change we will take reasonable steps to notify you, such as through the Service or by email. The date at the top of this page shows when it was last updated, and your continued use of the Service after a change means you accept the updated policy.

## 14. Contact us and how to complain

If you have a question, request or concern about your privacy, contact our Privacy Officer at privacy@darce.app (or hello@darce.app), or by mail at Kellert Labs Pty Ltd, Sunshine Coast, Queensland, Australia. We will acknowledge your enquiry and aim to respond within 30 days.

If you are not satisfied with how we handle a privacy issue, you can complain to the [Office of the Australian Information Commissioner (OAIC)](https://www.oaic.gov.au/), which can be contacted at oaic.gov.au or on 1300 363 992.
